Lässt sich ein Beklagter, der seinen gewöhnlichen Aufenthalt im Hoheitsgebiet eines anderen Staates als des Mitgliedstaats hat, in dem das Verfahren eingeleitet wurde, auf das Verfahren nicht ein, so setzt das zuständige Gericht das Verfahren so lange aus, bis festgestellt ist, dass es dem Beklagten möglich war, das verfahrenseinleitende Schriftstück oder ein gleichwertiges Schriftstück so rechtzeitig zu empfangen, dass er sich verteidigen konnte oder dass alle hierzu erforderlichen Maßnahmen getroffen wurden.
