Am 22. Juli 2011 focht die Deutsche Post den Ausweitungsbeschluss 2011 mit der Begründung an, die Kommission habe sich offensichtlich geirrt, als sie die Pensionssubvention in ihrer vorläufigen Würdigung als staatliche Beihilfe im Sinne des Artikels 107 Absatz 1 AEUV und als neue Beihilfe im Sinne des Artikels 108 Absatz 1 AEUV erachtete. On 22 July 2011, Deutsche Post challenged the validity of the 2011 Extension decision because it considers that the Commission has manifestly erred in its preliminary assessment of the pension subsidy as aid within the meaning of Article 107(1) TFEU and as a new aid measure in the meaning of Article 108(1) TFEU.
