	Die nach dem Datum der Eröffnungsentscheidung erfolgten Änderungen dieser Bestimmung, die mit dem Gesetz 16/2007 vom 4. Juli 2007 (Ley 16/2007 de 4 de julio de 2007) eingeführt wurden, sehen ferner vor, dass bei Nichterfüllung der Voraussetzung ii) für die Berechnung des Geschäfts- oder Firmenwerts als entrichteter Betrag derjenige Betrag zugrunde zu legen ist, den ein Unternehmen derselben Gruppe entrichtet hätte, wenn es die Beteiligung von nicht verbundenen natürlichen oder juristischen Personen erworben hätte, und es wird iii) die Bildung nicht verfügbarer Rücklagen in vergleichbarer Höhe verlangt. [EU]	The amendments made to this provision subsequent to the initiating Decision and brought in by Act No 16/2007 of 4 July 2007, also clarified that if condition (ii) was not met, the price paid used for calculating the goodwill will be the price paid for the share acquired by a related company to the unrelated seller and also required that (iii) a similar amount has been allocated to an indivisible reserve.
