Da das französische Recht die juristische Figur der Schuldübernahme auch nicht kennt und bei der Figur der Vertragsübernahme ('cession de contrat') alles vom vorherigen Einverständnis aller zu übernehmenden Vertragspartner (das in der Praxis quasi gar nicht zu erreichen ist) abhängig macht, kam es darauf an, dieses Hindernis zu überwinden.
