Métropole Télévisions (M6) vertritt in seiner Stellungnahme vom 2. November 2009 die Auffassung, bei dem geplanten Finanzierungsmechanismus handele es sich um eine staatliche Beihilfe im Sinne von Artikel 107 AEUV, insbesondere da die zweite und die vierte Voraussetzung des Altmark-Urteils nicht erfüllt seien. Denn ein Ausgleich, der auf einer Schätzung der entgangenen Werbeeinnahmen beruhe, die naturgemäß und de facto Schwankungen unterlägen, könne nicht als auf objektiven und transparenten Berechnungsparametern basierend angesehen werden. In its comments of 2 November 2009, Métropole Télévisions (M6) considers that the envisaged financing mechanism constitutes state aid within the meaning of Article 107 of the TFEU, especially since the second and fourth conditions laid down by the Altmark case-law are not met: compensation based on an estimate of loss of commercial revenues which by nature - and in fact - fluctuate could not be considered as based on objective and transparent parameters for the calculation of the public service costs.
