Article 45(2) of the Europe Agreement reads as follows: 'In respect of financial services, described in Annex XIIa, this Agreement does not prejudice the right of the Parties to adopt measures necessary for the conduct of the Party's monetary policy, or for prudential grounds in order to ensure the protection of investors, depositors, policy holders, or persons to whom a fiduciary duty is owed, or to ensure the integrity and stability of the financial system.

Hinsichtlich der Finanzdienstleistungen ist eine Vertragspartei ungeachtet anderer Bestimmungen dieses Abkommens nicht daran gehindert, aus aufsichtsrechtlichen Gründen, einschließlich des Schutzes von Investoren, Einlegern, Versicherungsnehmern oder von Personen, denen gegenüber ein Erbringer von Finanzdienstleistungen treuhänderische Pflichten hat, oder zur Gewährleistung der Integrität und Stabilität des Finanzsystems Maßnahmen zu treffen. In respect of financial services, notwithstanding any other provisions of this Agreement, a Party shall not be prevented from taking measures for prudential reasons, including for the protection of investors, depositors, policy holders or persons to whom a fiduciary duty is owed by a financial service supplier, or to ensure the integrity and stability of the financial system.
