Sofern dies im nationalen Recht des Anordnungsstaats zur Umsetzung von Artikel 12 vorgesehen ist, sollte die Anordnungsbehörde die Vollstreckungsbehörde ersuchen können, bestimmte Formvorschriften und Verfahren bei den gerichtlichen oder administrativen Handlungen einzuhalten, die dazu beitragen können, dass das angeforderte Material im Vollstreckungsstaat als Beweismittel zulässig ist, so z. B. die offizielle Abstempelung eines Dokuments, die Anwesenheit eines Vertreters des Anordnungsstaats oder die Aufzeichnung von Daten und Uhrzeiten zur Schaffung einer Beweiskette.
