Eine Tranche (oder Sub-Tranche) wird gegenüber anderen Tranchen (oder Sub-Tranchen) derselben Emission als nicht untergeordnet angesehen und ist vorrangig, wenn diese Tranche (oder Sub-Tranche) –; wie in den Emissionsbedingungen festgelegt –; gemäß der Zahlungsrangfolge, die nach Zustellung einer Mitteilung, dass diese Rangfolge zur Anwendung kommt (Enforcement Notice), gilt, gegenüber anderen Tranchen oder anderen Sub-Tranchen (in Bezug auf Kapitalbetrag und Zinsen) bevorzugt befriedigt wird oder in Bezug auf die zugrunde liegenden Vermögensgegenstände als Letzte von den Verlusten erfasst wird. A tranche (or sub-tranche) is considered to be non-subordinated vis-à-vis other tranches (or sub-tranches) of the same issue, and is 'senior' if, in accordance with the priority of payment applicable after the delivery of an enforcement notice, as set out in the offering circular, that tranche (or sub-tranche) is given priority over other tranches or sub-tranches in respect of receiving payment (principal and interest), or is last in incurring losses in relation to underlying assets.
