The Commission received comments from the French Confederation of Butchers, Delicatessens and Caterers (hereinafter 'CFBCT') on 18 October 2005 and from a private company on 17 October 2005 [4] and 11 July 2008.

Erstens wies die Confédération de la boucherie, boucherie-charcuterie, traiteurs (CFBCT) darauf hin, dass die fragliche Maßnahme nicht der Definition einer staatlichen Beihilfe entsprochen habe und dass der auf bestimmte Unternehmen angewandte Abgabenmechanismus, der sich auf den Umsatz bezog, nach den allgemeinen Grundsätzen des Steuersystems voll und ganz gerechtfertigt gewesen sei. Firstly, the Confederation of Butchers, Delicatessens and Caterers (hereinafter 'CFBCT') pointed out that the measure in question did not meet the criteria for the definition of State aid and that the tax mechanism applied to certain companies on the basis of the amount of their turnover was fully justified owing to the general scheme of the tax system.
