Application for a decision not going to the substance of the case

Entscheidet ein Gericht eines Mitgliedstaats, ob eine Schiedsvereinbarung hinfällig, unwirksam oder nicht erfüllbar ist, so sollte diese Entscheidung ungeachtet dessen, ob das Gericht darüber in der Hauptsache oder als Vorfrage entschieden hat, nicht den Vorschriften dieser Verordnung über die Anerkennung und Vollstreckung unterliegen. A ruling given by a court of a Member State as to whether or not an arbitration agreement is null and void, inoperative or incapable of being performed should not be subject to the rules of recognition and enforcement laid down in this Regulation, regardless of whether the court decided on this as a principal issue or as an incidental question.

Geht aus diesen Umständen nicht eindeutig hervor, welche Urkunde, wenn überhaupt, Vorrang haben sollte, so sollte diese Frage von den gemäß dieser Verordnung zuständigen Gerichten oder, wenn die Frage als Vorfrage im Laufe eines Verfahrens vorgebracht wird, von dem mit diesem Verfahren befassten Gericht geklärt werden. Where it is not clear from those circumstances which authentic instrument, if any, should be given priority, the question should be determined by the courts having jurisdiction under this Regulation, or, where the question is raised as an incidental question in the course of proceedings, by the court seised of those proceedings.

Hängt die Entscheidung des Gerichts eines Mitgliedstaats von der Klärung einer Vorfrage mit Bezug auf die in einer öffentlichen Urkunde beurkundeten Rechtsgeschäfte oder Rechtsverhältnisse in Erbsachen ab, so ist dieses Gericht zur Entscheidung über diese Vorfrage zuständig. [EU]

If the outcome of proceedings in a court of a Member State depends on the determination of an incidental question relating to the legal acts or legal relationships recorded in an authentic instrument in matters of succession, that court shall have jurisdiction over that question.

Trat eine nach Artikel 2 Absatz 2 oder nach Artikel 21 ausgeschlossene Angelegenheit als Vorfrage auf, so wird die Beurteilung dieser Frage nicht nach diesem Übereinkommen anerkannt oder vollstreckt. [EU]

Where a matter excluded under Article 2(2), or under Article 21, arose as a preliminary question, the ruling on that question shall not be recognised or enforced under this Convention.
