§ 1 Ein Vorabentscheidungsersuchen, das eine oder mehrere Fragen zu den von Titel VI des Unionsvertrags oder Titel IV des Dritten Teils des EG-Vertrags erfassten Bereichen aufwirft, kann auf Antrag des nationalen Gerichts oder ausnahmsweise von Amts wegen einem Eilverfahren unter Abweichung von den Bestimmungen dieser Verfahrensordnung unterworfen werden. A reference for a preliminary ruling of the kind referred to in the preceding paragraph shall, where the national court or tribunal has requested the application of the urgent procedure or where the President has requested the designated Chamber to consider whether it is necessary to deal with the reference under that procedure, be notified forthwith by the Registrar to the parties to the action before the national court or tribunal, to the Member State from which the reference is made and to the institutions referred to in the first paragraph of Article 23 of the Statute, in accordance with that provision.

Having regard to the objectives of simplicity and cost-effectiveness, the court or tribunal should order that an unsuccessful party be obliged to pay only the costs of the proceedings, including for example any costs resulting from the fact that the other party was represented by a lawyer or another legal professional, or any costs arising from the service or translation of documents, which are proportionate to the value of the claim or which were necessarily incurred.
