On 4 January 2010, the Commission received a complaint concerning imports of melamine originating in the People's Republic of China lodged pursuant to Article 5 of the basic Regulation by Borealis Agrolinz Melamine GmbH, DSM Melamine BV and Zakł;ady Azotowe Puł;awy ('the complainants'), representing a major proportion, in this case more than 50 %, of the total Union production of melamine.

Aus den dargelegten Gründen wird die Behauptung zurückgewiesen und es wird bestätigt, dass das vom Wirtschaftszweig der Union hergestellte und in der Union verkaufte Melamin, das von der VR China hergestellte und auf dem Markt der VR China verkaufte Melamin und das aus der VR China in die Union eingeführte Melamin sowie das im Vergleichsland Indonesien hergestellte und verkaufte Melamin als gleichartig im Sinne des Artikels 1 Absatz 4 der Grundverordnung angesehen werden. Based on the above, the claim is rejected and it is hereby confirmed that melamine produced and sold by the Union industry in the Union, melamine produced and sold on the domestic market of the PRC and melamine imported into the Union from the PRC, as well as that produced and sold in Indonesia, which served as the analogue country, are considered to be alike within the meaning of Article 1(4) of the basic Regulation.
