Abweichend von Artikel 90 EG-Vertrag wird Portugal hiermit ermächtigt, in der autonomen Region Madeira in Bezug auf die dort hergestellten und verbrauchten Rum- und Likörerzeugnisse sowie in der autonomen Region Azoren in Bezug auf die dort hergestellten und verbrauchten Likör- und Branntweinerzeugnisse einen Verbrauchsteuersatz anzuwenden, der unter dem in Artikel 3 der Richtlinie 92/84/EWG festgelegten vollen Verbrauchsteuersatz für Alkohol liegt. By way of derogation from Article 90 of the Treaty, Portugal is hereby authorised to apply a rate of excise duty lower than the full rate on alcohol laid down in Article 3 of Directive 92/84/EEC in the autonomous region of Madeira, to locally produced and consumed rum and liqueurs, and in the autonomous region of the Azores, to locally produced and consumed liqueurs and eaux-de-vie.

'alcoholic products' means products (beer, wine, aperitifs with a wine or alcohol base, brandies, liqueurs or spirituous beverages, etc.) falling within heading Nos 2203 to 2208 of the Combined Nomenclature.

Dezember 1959 zur Aufnahme bestimmter Waren in die Liste des Anhangs II des Vertrages zur Gründung der Europäischen Wirtschaftsgemeinschaft geht es um "Äthylalkohol, vergällt oder unvergällt, mit einem beliebigen Alkoholgehalt, hergestellt aus landwirtschaftlichen Erzeugnissen, die in Anhang I EG-Vertrag aufgeführt sind (ausgenommen Branntwein, Likör und andere alkoholische Getränke, zusammengesetzte alkoholische Zubereitungen –; Essenzen - zur Herstellung von Getränken)". Annex I to the Treaty as amended by Council Regulation No 7a adding certain products to the list in Annex II to the Treaty establishing the European Economic Community [22] refers to 'Ethyl alcohol or neutral spirits, whether or not denatured, of any strength, obtained from agricultural products listed in Annex I to the Treaty, excluding liqueurs and other spirituous beverages and compound alcoholic preparations (known as "concentrated extracts") for the manufacture of beverages'.
