	(10) Artikel 16 Absatz 4 der Verordnung (EG) Nr. 1924/2006 sieht vor, dass eine Stellungnahme, in der die Zulassung einer gesundheitsbezogenen Angabe befürwortet wird, bestimmte Informationen enthält. [EU]	Article 8(1) of Regulation (EC) No 1924/2006 provides that nutrition claims made on foods shall only be permitted if they are listed in the Annex to that Regulation, which also sets out the conditions of use of such claims.
	Alle gesundheitsbezogenen Angaben, die Gegenstand der vorliegenden Verordnung sind, sind Angaben gemäß Artikel 13 Absatz 1 Buchstabe a der Verordnung (EG) Nr. 1924/2006, weshalb für sie die in Artikel 28 Absatz 5 der genannten Verordnung festgelegte Übergangsfrist gilt. [EU]	All the health claims subject to this Regulation are health claims as referred to in point (a) of Article 13(1) of Regulation (EC) No 1924/2006 and may benefit from the transition period laid down in Article 28(5) of that Regulation.

	Artikel 13 Absatz 1 Buchstabe c der Verordnung (EG) Nr. 1924/2006 lässt unter bestimmten Voraussetzungen gesundheitsbezogene Angaben über Lebensmittel zu, die insbesondere eine Verringerung des Hungergefühls bzw. ein verstärktes Sättigungsgefühl beschreiben oder darauf verweisen. [EU]	Article 13(1)(c) of Regulation (EC) No 1924/2006 allows the use on foods of health claims describing or referring in particular to a reduction in the sense of hunger or an increase in the sense of satiety under specified conditions.
	Artikel 7 Absätze 1 und 2 der Verordnung (EG) Nr. 1924/2006 erhalten folgende Fassung: [EU]	The first and second paragraphs of Article 7 of Regulation (EC) No 1924/2006 are replaced by the following:
	Artikel 8 Absatz 1 der Verordnung (EG) Nr. 1924/2006 legt fest, dass nährwertbezogene Angaben über Lebensmittel nur verwendet werden dürfen, wenn sie im Anhang der Verordnung aufgeführt sind, in dem auch die Verwendungsbedingungen festgelegt werden. 	Auf der Kennzeichnung von Erzeugnissen, denen Vitamine und Mineralstoffe zugesetzt wurden, darf nach Maßgabe der Verordnung (EG) Nr. 1924/2006 ein Hinweis auf diesen Zusatz angebracht werden. [EU]	The labelling of products to which vitamins and minerals have been added may bear a statement indicating such addition under the conditions laid down in Regulation (EC) No 1924/2006.
	Bei Anträgen auf Zulassung gesundheitsbezogener Angaben sollten die Bestimmungen der Verordnung (EG) Nr. 1924/2006, insbesondere die allgemeinen Grundsätze und Bedingungen der Artikel 3 und 5, berücksichtigt werden. [EU]	Applications for health claims should take account of the requirements laid down in Regulation (EC) No 1924/2006, particularly the general principles and conditions set out in Articles 3 and 5 thereof.
	Bei den Angaben "Durch seine Zusammensetzung aus Milchpeptid und Magnesium hilft dieses Produkt, Anzeichen von Angstgefühlen bei leicht stressempfindlichen Erwachsenen zu lindern" und "Schwarzer Tee fördert die Konzentration" handelt es sich um gesundheitsbezogene Angaben gemäß Artikel 13 Absatz 1 Buchstabe b der Verordnung (EG) Nr. 1924/2006. [EU]	The health claims 'This product helps moderate signs of anxiety in mildly stress-sensitive adults due to its milk peptide and magnesium content', and 'Black tea helps you to focus attention' are health claims as referred to in Article 13(1)(b) of Regulation (EC) No 1924/2006.
	Beide unterliegen daher den Übergangsmaßnahmen nach Artikel 28 Absatz 6 der Verordnung (EG) Nr. 1924/2006. [EU]	Therefore they are both subject to the transition measures laid down in Article 28(6) of Regulation (EC) No 1924/2006.

	Bezüglich der Angabe, die Gegenstand der vorliegenden Verordnung ist, kam die Behörde zu dem Schluss, dass zwischen dem Verzehr des Lebensmittels und der angegebenen Wirkung kein kausaler Zusammenhang hergestellt wurde und dass diese Angabe daher nicht der Verordnung (EG) Nr. 1924/2006 entspricht, sodass die Übergangsfrist gemäß Artikel 28 Absatz 5 dieser Verordnung nicht in Anspruch genommen werden kann. [EU]	As for the claim subject to the present Regulation, the Authority concluded that a cause and effect relationship had not been established between the consumption of the food and the claimed effect and thus it does not comply with the Regulation (EC) No 1924/2006 and it could not benefit from the transition period foreseen in Article 28(5) of that Regulation.
	Bezüglich der Angabe, die Gegenstand der vorliegenden Verordnung ist, kam die Behörde zu dem Schluss, dass zwischen der Aufnahme des Lebensmittels und der angegebenen Wirkung kein kausaler Zusammenhang hergestellt wurde und dass diese Angabe somit nicht der Verordnung (EG) Nr. 1924/2006 entspricht, so dass die Übergangsfrist gemäß Artikel 28 Absatz 5 der genannten Verordnung nicht in Anspruch genommen werden kann. 	Bezüglich der sieben nicht veröffentlichten Studien ist davon auszugehen, dass die Anforderungen des Artikels 21 Absatz 1 der Verordnung (EG) Nr. 1924/2006 erfüllt sind. 	Bezüglich der zwei Studien, die vor der Einreichung des Antrags auf Zulassung der gesundheitsbezogenen Angabe veröffentlicht wurden, wird davon ausgegangen, dass die Ziele der Verordnung (EG) Nr. 1924/2006 den Schutz dieser Studien nicht rechtfertigen, da sie bereits veröffentlicht und damit der Öffentlichkeit zugänglich gemacht wurden; dort heißt es unter anderem, dass "Investitionen, die von Innovatoren bei der Beschaffung von Informationen und Daten zur Unterstützung eines Antrags auf Zulassung nach dieser Verordnung getätigt werden, zu schützen" sind. [EU]	For the two studies, which had been published prior to the submission of the application for authorisation of the health claim [3], it is considered that as the studies have been published and made available to the public domain, their protection is not justified in the light of the objectives of Regulation (EC) No 1924/2006 among which to protect the investment made by innovators in gathering the information and data supporting an application under that Regulation and accordingly it should not be granted.
