März 1997 gewährten Beihilfe in Höhe von 700000 EUR machen die spanischen Behörden geltend, dass diese Beihilfe als Erweiterung der Beihilferegelung N 448/94 für KMU von Asturien zu betrachten ist (die ausnahmsweise auch für Großunternehmen gilt, wenn sie zur Regionalentwicklung beitragen) und dass sie eine Ergänzung zu der 1994 von Spanien nach dem Gesetz 50/85 (LIR) gewährten Regionalhilfe darstellt. As regards the EUR 730000 in aid granted on 14 March 1997 by the Asturias regional government under Decree 7/96, the Spanish authorities claim that this aid should be regarded as an extension of scheme N 448/94 in support to SMEs in Asturias (exceptionally applicable to large companies contributing to regional development), and that it would constitute a complement to regional aid granted in 1994 by Spain under Law 50/85 (LIR).

Mit Blick auf die zuvor im Abschnitt IV beschriebenen Auskünfte Spaniens ist die Kommission der Ansicht, dass die Bürgschaft der Regionalregierung von Asturien durch die festen Forderungsrechte von Chupa Chups gegenüber verschiedenen öffentlichen Behörden gesichert war. [EU]

In view of the information provided by Spain, as described under section IV above, the Commission considers that the endorsement by the Asturias regional government was guaranteed by the firm credit rights that Chupa Chups had vis-à-vis several public authorities.

Spain has now submitted supporting documentation to the Commission as regards the programme in place in the Autonomous Communities of Galicia, País Vasco, Asturias, Cantabria, Navarra, La Rioja, and the provinces of León, Zamora, Palencia, Burgos, Valladolid and Ávila in the Autonomous Community of Castilla y León and the province of Las Palmas in the Canary Islands and requested the approval of this programme.

Spanien legte Beweise dafür vor, dass die Beihilfe auf die Erstinvestition begrenzt war, dass die beihilfefähigen Kosten innerhalb der vorgesehenen Grenzen der Leitlinien von 1998 lagen, dass die Intensität die für Asturien damals geltenden regionalen Höchstgrenzen einhielten, dass die Kumulierungsvorschriften eingehalten wurden, dass mindestens 25 % der Investition aus Eigenmitteln des Empfängers stammten und die Investition innerhalb von fünf Jahren nach dem Datum der Beihilfegewährung erfolgte. In particular, Spain has provided evidence that the aid was limited to the initial investment, that eligible costs were among those considered in the 1998 RAG, that the intensity of the aid respected the regional ceilings applicable in Asturias at the time, that accumulation rules were respected, that at least 25 % of the investment was financed with the beneficiary's own resources, and that the investment was kept more than five years after the date the aid was granted.

Unter Berücksichtung aller Argumente kommt die Kommission zu dem Schluss, dass die Intervention der Regierung von Asturien kein bedeutendes Risiko war und daher keine staatliche Beihilfe darstellte. [EU]

In the light of the above, the Commission concludes that the intervention of the Asturias government did not involve any significant risk and therefore did not constitute State aid.

Was die beiden nach Maßgabe des Dekrets 41/2000 gewährten Beihilfen angeht, so stellt die Kommission fest, dass dieses Dekret mit dem Beschluss 30/05/2000 angenommen wurde, dass Chupa Chups 2000 und 2002 (als die Beihilfen gewährt wurden) noch für die Regionalbeihilfe in Betracht kam und dass die Höchstgrenzen der Regionalbeihilfe für Asturien eingehalten wurden. Regarding the two subsidies granted under Decree 41/2000, the Commission notes that the latter decree was approved by decision of 30 May 2000, that in 2000 and 2002 (when the subsidies were granted) Chupa Chups was still eligible for regional aid, and that the regional aid ceilings for Asturias were respected.
