Auf Antrag der Kommission hat die Europäische Konferenz der Verwaltungen für Post und Telekommunikation ("CEPT") technische Berichte vorgelegt, in denen nachgewiesen wurde, dass das UMTS-System ("Universal Mobile Telecommunications Systems") neben GSM-Systemen störungsfrei im 900-MHz-Band betrieben werden könnte. As requested by the Commission, the European Conference of Postal and Telecommunications Administrations (CEPT) has produced technical reports demonstrating that UMTS systems (Universal Mobile Telecommunications System) could coexist with GSM systems in the 900 MHz band.

Auf der Grundlage technischer Untersuchungen, vor allem der Berichte 82 und 96 des Ausschusses für elektronische Kommunikation (ECC) der CEPT und des aufgrund des Mandats vom 5. Juli 2006 ausgearbeiteten CEPT-Berichts 19 kam die CEPT zu dem Schluss, dass UMTS/900/1 800-Netze in städtischen Ballungszentren und deren Randgebieten sowie in ländlichen Gebieten bei Einhaltung ausreichender Trägerfrequenzabstände neben GSM/900/1 800-Netzen störungsfrei eingeführt werden können. Working on the basis of technical investigations, in particular Reports 82 and 96 of the Electronic Communications Committee (ECC) of the CEPT, and on the response to the mandate of 5 July 2006 in CEPT Report 19, the CEPT has concluded that UMTS/900/1 800 networks can be deployed in urban, sub-urban and rural areas in coexistence with GSM/900/1 800 networks, using appropriate values for carrier separation.

The 900 MHz band should therefore be opened to UMTS, a system that can coexist with GSM systems, as well as to other systems as soon as it can be demonstrated that they can coexist with GSM systems in accordance with the procedure laid down in the Radio Spectrum Decision for the adoption of harmonised conditions for the availability and efficient use of radio spectrum.

Member States shall make the 880-915 MHz and 925-960 MHz frequency bands (the 900 MHz band) available for GSM and UMTS systems, as well as for other terrestrial systems capable of providing electronic communications services that can coexist with GSM systems, in accordance with technical implementing measures adopted pursuant to Decision No 676/2002/EC of the European Parliament and of the Council of 7 March 2002 on a regulatory framework for radio spectrum policy in the European Community (Radio Spectrum Decision).

Member States shall, no later than 12 months following the entry into force of this Decision, make available at least 2 MHz of spectrum in the uplink direction and 2 MHz of corresponding paired spectrum in the downlink direction within the 900 MHz and/or 1800 MHz bands for systems providing MCV services on a non-interference and non-protected basis in their territorial seas, and ensure that these systems comply with the conditions set out in the Annex to this Decision.

Member States should strive to make available, as early as possible, the entire 900 MHz and 1800 MHz frequency bands for systems providing MCV services on a non-interference and non-protected basis in their territorial seas in order, for example, to avoid discrimination between rights holders in these bands.

Die Mitgliedstaaten sorgen dafür, dass die Frequenzbänder für Geräte mit geringer Reichweite entsprechend den besonderen Bedingungen im Anhang dieser Entscheidung bis zum genannten Umsetzungstermin festgelegt werden und nicht-exklusiv, störungsfrei und ungeschützt zur Verfügung stehen. [EU]

Member States shall designate and make available, on a non-exclusive, non-interference and non-protected basis, the frequency bands for the types of short-range devices, subject to the specific conditions and by the implementation deadline, as laid down in the Annex to this Decision.

Die Mitgliedstaaten sorgen innerhalb von sechs Monaten nach Inkrafttreten dieser Entscheidung dafür, dass die Frequenzbänder für RFID-Geräte entsprechend den besonderen Bedingungen im Anhang dieser Entscheidung festgelegt werden und nicht-exklusiv, störungsfrei und ungeschützt zur Verfügung stehen. Member States shall designate and make available, within six months after the entry into force of this Decision and on a non-exclusive, non-interference and non-protected basis, the frequency bands for RFID devices, subject to the specific conditions, as laid down in the Annex to this Decision.

The use of radio spectrum by equipment using ultra-wideband technology under this Decision is to be allowed on a non-interference and non-protected basis and therefore should be subject to Article 5(1) of Directive 2002/20/EC of the European Parliament and of the Council of 7 March 2002 on the authorisation of electronic communications networks and services [8].

Entsprechend den Vorgaben der Richtlinie 87/372/EWG zur Öffnung des 900-MHz-Bands sollte das gegenwärtig für GSM genutzte 1800-MHz-Band daher ebenfalls für GSM und andere terrestrische Systeme, die elektronische Kommunikationsdienste erbringen und störungsfrei neben GSM-Systemen betrieben werden können, zugewiesen werden, wobei die Mitgliedstaaten alle notwendigen Maßnahmen treffen sollten, damit der Betrieb der GSM-Systeme vor funktechnischen Störungen geschützt bleibt. In line with the approach taken to the opening of the 900 MHz band by Directive 87/372/EEC, the 1800 MHz band currently used for GSM should therefore also be designated for GSM and for other terrestrial systems capable of providing electronic communications services which can coexist with GSM systems, and Member States should take whatever measures are necessary to protect the continued operation of GSM systems from harmful interference.
